ACWAafia case hearing adjourned until 27th

The Lahore High Court on Monday adjourned till August 27 the hearing of a habeas corpus petition seeking the recovery of Dr. Aafia Siddiqui from American detention. The court adjourned hearing after a deputy attorney general filed a written request on behalf of the Foreign Affairs and Interior ministries.

The court had directed both the ministries to apprise it about the developments in Dr Aafia case, and whether the government had any objection about referring the matter to the International Court of Justice (ICJ).

Petitioner Barrister Iqbal Jaffree submitted that former General (retd) Pervez Musharraf had given away more than 9,000 citizens in American custody. He requested the court to direct the government to take steps for bringing Dr. Aafia back to the country, and in case the matter is not resolved, it must be taken to the International Court of Justice under the 1959 treaty, signed by both the countries. According to her family, Dr Afia was arrested from Karachi on March 30 2003 outside her house and was taken to Afghanistan. Later, she was transported to the US, where she was being tried under terrorism charges for attempting to kill two American investigators.

Two of her American national children are reportedly still missing while one of her children has been handed over to her sister by the Interior Ministry. In this case, the court had also restrained the Federal Government from releasing $20million to three American lawyers for pleading the case of Dr Aafia in American courts. The court directed the government to submit reply in this regard.
