Plea for FIR cancellation withdrawn

RAWALPINDI: A marketing manager of Bahria Town, Waleed Aman, who is an accused in the December 5 car racing tragedy, on Tuesday withdrew his quashment (annulment) of FIR application from the Lahore High Court (LHC), Rawalpindi Bench.

Earlier, the petitioner, through his legal counsel SM Zafar, sought from the court to quash the FIR to his extent only. SM Zafar argued before Justice Ijaz Ahmed of the LHC that his client was neither among the organisers of the December 5 car race event nor was he the driver of the car that hit the spectators.

The petitioner told the court that a private person organised the event and he had asked the organisers to seek the permission of the city district government of Rawalpindi for the event. The counsel withdrew this application after the court asked him to wait for the orders.

In the FIR registered with the Rawat Police Station, Waleed Aman has been accused of abetment to the crime of killing of five spectators after a racing car crushed them.

Waleed contended before the court that the insertion of Section 302 of PPC in this case was unjustified because it was in no way intentional murder, and he prayed to the court to suspend the investigations against him. The petitioner argued before the court that he had not directly been accused of killing anybody and the charge of abetment could not be proved, as the driver of the car did not kill the spectators intentionally.

The petitioner also told the court that the investigation officer of the case declared him innocent on December 9, but later the police inserted Section 302 in the case and started fresh investigations against him.
