A division bench of the Lahore High Court on Thursday adjourned hearing until September hearing of a 17-year old case seeking cancellation of residential plots allotted to 28 judges of the Lahore high Court in 1993 during Nawaz Sharif’s tenure as Prime Minister.
On Thursday, a representative of the Lahore Development Authority (LDA) appeared before the court and sought time to complete record and furnish the same before the court.
The bench, comprising Justice Muhammad Khalid Mehmood Khan and Justice Syed Kazim Raza Shamsi, is hearing an intra-court appeal against decision of a single bench. The case was filed by a lawyer, Saif-ul-Haq Zayee, in 1993 and the single bench had dismissed it in 1994. He challenged that order through an ICA was never heard after 2002.
The petitioner pointed out that allotment of plots to LHC judges was unlawful as proceedings laid down by the LDA were not followed during allotment of plots in the Johar Town and Garden Town..
He pointed out that under rules plots could only be allotted to the judges who did not have any plot for residential purposes. To this extent the judges have also submitted affidavits.
The petitioner pleaded the court through ICA to set aside the order of single bench and cancel the plots allotted to the judges.
The petitioner had filed an application for early hearing of his ICA case and the Chief justice fixed the case before the division bench.
