ISLAMABAD: The Supreme Court Friday stayed the balloting of plots being allotted to employees of Capital Development Authority (CDA) and asked director of the authority to present the relevant record on May 4, 2011.
The direction was given on a petition filed by Zahooruddin and six other CDA employees. A two-member bench of the court, comprising Justice Nasirul Mulk and Justice Jawwad S Khawaja, was hearing the case.
Counsel for the petitioners Rai Nawaz Kharal submitted before the court that his clients were grade 4 to 5 employees in the CDA. He submitted that petitioners No 1, 2, 3, 5, 6, and 7 were regular and permanent employees of the CDA. They were holding the posts as shown against their names during the pendency of the appeal but have retired since then. The petitioner at S No 7, died on June 20, 2008. Following his death, his case is pursued by his widow Mst Gul Nadir. Petitioner No 4 is still serving in the CDA, on the post shown against his name.
He submitted that on December 7, 2006 all the present petitioners filed a writ petition before the Lahore High Court Rawalpindi Bench during which they were promoted. He submitted that the CDA called for applications from its employees for the allotment of plots. As a consequence of the said applications, they were allotted plots each measuring 25×60 square yards in Sector I-11/1 & I-11/2, Islamabad vide allotment letters issued in 1990.
