Supreme Court allows construction of three-storey plazas in Lahore

A Supreme Court Bench Monday allowed construction of plazas and commercial buildings in city up to three storey provided they are duly backed for approval of construction plan by the competent authority, certification of structural stability and environment protection and others relevant specified in this court order dated May 24 and May 31 last.

The Bench headed by Mr Justice Khalilur Rahman Ramday while making the said dated orders of this court operational, has directed the multi-storey builders that on reaching construction up to three storey, they would get the construction inspected by the Commission appointed by this Court under Justice ® Riaz Kiyani to ascertain whether construction has been done as per the specifications and requirements and after approval from the Commission, building would be raised to further height. If the construction has been approved and other allied needs fulfilled, the Court order would apply to the general builders on the commercial sites.

The bench also, comprising Justice Falak Sher, has decided to hear day to day the matter relating to sky-rise buildings in Lahore as most of them located at prime sites, have been found illegally built for not having proper approval of plan, exceeding the height and depth limit in basement in deviation of the approved plan or not leaving the side space required under the bylaws of the Lahore Development Authority.

In the first instance the Court had completely stayed construction of the commercial buildings and had subjected them to survey through the Commission to know which of them had been developed according to the bylaws.

Now the Court has required the builders to the reach the Commission after competing three storeys for inspection of by it and in that view, permission for further construction.

A plea was moved to the Court by National Communication Service (Duniya TV) through Shahram Sarwar Ch to inform the court that after completing three storeys, they wanted to go further up.

The Court asked the counsel to get the building inspected by the Commission ever on priority basis, and go further high if it would certify that the construction was as per the requirements under the law. Afrab Gull advocate for Boulevard Heights sought permission to resume the construction after it was stayed last years at the plinth level. He said the building was going on after fulfilling all of conditions provided for quality construction. The Court permitted it construction subject to inspection by the Commission and its approval. The Court pleaded neighbouring residents of Masood Hospital, which has sough demolition o of the new block of the Hospital, as party to the matter.

The Court also recalled the earlier passed suspension order against three LDA officers. Senior advocate Mian Qamaruz Zaman appeared for LDA.
