Land mafia rules the capital

Multiple nominations, complications force citizens to rush courts

* Over 2,308 cases registered at courts during 2010-11; majority from developing areas

ISLAMABAD: On one hand cost of property in capital is running high and on other hand land mafia is in full boom for its vested interests causing land disputes to reach considerably high while the persons involved in these cases are hopeless as they see no hope of solution to these problems as it takes decades to resolve.

An examination of record at district courts unveiled that there are 2,308 cases registered in district court during year 2010-11, in which mostly cases were registered against the private housing societies in which the landowner sells one plot to three or four persons separately.

It was also known that majority of the disputes are on the rise in the areas of city that are less developing as Satellite Town. Many of the cases have been reported from localities like Alipur Farash, Phulgaran, Bhara Kahu, Sihala and those falling in the northern and western parts of capital.

Former Additional Sessions Judge (ASJ) Tanveer Meer’s court received 342 cases of land dispute and all of them were registered during the year 2010-11, in which 129 cases were reported about land dispute from Alipur Farash, 146 from Bahar Kahu and 67 from the area of Sihala.
The court of former ASJ Akmal Khan received 422 cases of land dispute and was registered during the year 2010-11, in which 198 land dispute cases were from Alipur Farash, 187 cases from Bahar Kahu and 37 cases from Sihala.

The court of ASJ Wajaht Hussain received 268 cases of land dispute in 2010-11, in which 119 land dispute were reported from the area of Alipur Farash, 103 from Bahar Kahu and 46 cases of land dispute from the area of Sihala.

Court of Senior Civil Judge Mahmood Haroon received 395 cases of land dispute in 2010-11, in which 263 were from the area of Alipur Farash, 108 from the area of Bahar Kahu and 24 from the area of Sihala.
Civil Judge Shabana Hameed Mughal received 276 cases of land dispute in 2010-11, in which 162 were registered from Alipur Farash, 83 in Bahar Kahu and 31 from Sihala.

Civil Judge Wajid Hussain Mughal’s court received 382 cases of land dispute in which 216 were related to land dispute from the area of Alipur Farash, 106 in Bahar Kahu and 60 cases of land dispute from the area of Sihala.

Civil Judge Ameer Mukhtar Gondal received 223 cases in 2010-11, in which 115 were from the area of Alipur Farash, 83 from the area of Bahar Kahu and 23 cases of land dispute from the area of Sihala.
According to law, sale of real estate in Pakistan normally takes place through a title document known as a Sale Deed, except in certain cases e.g. purchase of real estate in Defence Housing Authority (DHA) or in a housing society where sale deed is not executed for transfer of title in real estate and an allotment letter/transfer letter from the authority or the society, as the case may be, is deemed to be the title document. Some people, before execution of the sale deed, may opt to execute an agreement to sell.

According to court official, disputes over land issues are on the increase in the federal capital. Locals in and around the city allegedly sell their lands and then try to cancel the agreements. He said that land ownership is highly concentrated in rural areas of capital and a root cause of persistent poverty and instability countrywide. He said that the land dispute is a burning issue in district court because the property price is very expensive in Islamabad and with the passage of time it is increasing. He said that these cases take so long generation-to-generation but their issues are not resolving.

A victim of land dispute Muhammad Nawaz, filed case no 131 in years 1995 but till to date case is pending in the civil court. He said that he has spent million of rupees to get resolve my case but all went in vain.
