    SUBJECT:- REQUEST FOR THE IMMPLIMINTION OF PRIORITIES WERE FIXED FOR ALLOTMENT OF RESIDENTIAL PLOTS TO EMPLOYEES TO THE EFFECT THAT EMPLOYEES HAVING NO HOUSE IN ANY MAJOR CITY OF PAKISTAN SHALL BE GIVEN FIRST PRIORITY AND THOSE HAVING NO HOUSE IN ISLAMABAD ALONE SHALL HAVE SECOND PRIORITY. AND CDA TO PREPARE THE LIST OF EMPLOYEES IN GRADE BPS-1 TO 16 WHO HAVE 08 YEARS REGULAR SERVICE AT THIR CREDIT AND THE SENIORITY OF THE OFFICIALS IN A PARTICULAR CATEGORY OF PLOT IS TO BE FIXED IN THE LIGHT OF THE SUBSTANTIVE APPOINTMENT AND PROMOTION ACCORDING TO THE CDA SERVICE REGULATION, RULES 1992, AFTER THE UPGRADED EMPLOYEES HAVE TO INCLUDE IN THE GRADE WHICH THEY WERE SUBSTANTIALLY HOLDING IMMEDIATELY BEFORE THE UPGRADATION. SO THAT THE RIGHT OF ACTUAL ENTITLED OF PLOTS, AND ACTUAL SENIOR OFFICIALS IS NOT DAMAGED. THE CDA UP-GRADATION OF POST NOT A PROMOTION BUT IS ONLY A PERSONAL BENEFIT OF THE PRESENT HOLDERS OF SAID POST FOR INCREASING THEIR SALARY.

    WITH DUE RESPECTED THAT WE WOULD LIKE TO RECALL YOUR HONOR KIND ATTENTION TO OUR APPLICATION EARLIER SUBMITTED ON THE SUBJECT NOTED ABOVE IN WHICH WE HAVE EXPLAIND ALL THE FACTS AND CIRCUMSTANCE,

    THAT THE FEDERAL GOVERNMENT IN THE MINISTRY OF HOUSING HAD FRAMED A SCHEME FOR ALLOTMENT OF RESIDENTIAL PLOTS TO THE PUBLIC SERVANTS POSTED IN ISLAMABAD.

    THAT THE IMPLEMENTATION OF THE ABOVE SAID SCHEME CONCEIVED IN THE MINISTRY OF HOUSING & WORKS WAS ENTRUSTED TO CELL CREATED IN THE SAID MINISTRY.THIS SCHEME WAS TO BE ESTABLISHED ON THE LAND ACQUIRED & OWNED BY THE CDA IN SECTOR, I-8. THIS CELL WAS ABOLISHED ON 26th MARCH 1990 & ITS FUNCTIONS WERE ENTRUSTED TO THE FEDERAL GOVERNMENT EMPLOYEES HOUSING FOUNDATION, A COMPANY INCORPORATED UNDER THE COMPANIES ORDINANCE 1984.

    THE FOLLOWING PRIORITIES WERE FIXED FOR ALLOTMENT OF RESIDENTIAL PLOTS.

    1……..FIRST PRIORITY:
    THOSE EMPLOYEES WHO DID NOT OWN HOUSE EITHER IN NAME OR IN THE NAME OF THEIR FAMILY MEMBERS IN ANY MAJOR CITY OF PAKISTAN.

    2…….SECOND PRIORITY:
    THOSE WHO DO NOT HAVE A HOUSE IN ISLAMABAD EITHER IN THEIR NAME OR IN THE NAME OF ANY MEMBER OF THE FAMILY.

    TO THE EFFECT THAT EMPLOYEES HAVING NO HOUSE IN ANY MAJOR CITY OF PAKISTAN SHALL BE GIVEN FIRST PRIORITY AND THOSE HAVING NO HOUSE IN ISLAMABAD ALONE SHALL HAVE SECOND PRIORITY.

    THAT THE MAJORITY OF THE EFFECTED ARE THOSE EMPLOYEES HAVING NO HOUSE IN ANY MAJOR CITY OF PAKISTAN AND ISLAMABAD EITHER IN THEIR NAME OR IN THE NAME OF ANY MEMBER OF THE FAMILY. WHO COULD NOT BE ALLOTTED RSIDENTIAL PLOTS IN THE ROUND OF ALLOTMENT, THAY ARE ENTITLED TO THE ALLOTMENT OF PLOTS ACCORDING TO THE FIRST PRIORITY AND SECOND PRIORITY OF FIXED FOR ALLOTMENT OF RESIDENTIAL PLOTS.

    BUT THAT THE CDA AUTHORITY MANY PLOTS ALLOTED AND GIVES TO EMPLOYEES THAY HAD BEEN ALRADY HOUSE IN ISLAMABAD EITHER IN THEIR NAME OR IN FAMILY MEMBERS NAMES

    THERE HAS BEEN LOT OF LITIGATION IN THE SUPERIOR COURTS AS WELL AS BEFORE THE HONORABLE WAFAQI MOHTASIB .SOME OF THE APPLICANTS HAD TO INDULGE IN THIS LITIGATION AGAINST THE CDA FOR PROTECTING THEIR RIGHTS. THE LAST TWO ORDERS WHICH MAY BE REFERRED ARE DATED 21 ST JANUARY 2004 PASSED BY IN THE LAHORE HIGH COURT /RAWALPINDI BENCH, HONORABLE COURT AND ORDER DATED 28-11-2005 OF THE HONORABLE SUPREME COURT.

    THAT ON THE DEMOND OF MAZDOOR UNION OF CDA FOR INCREASE IN PAY, THE AUTHORITY DECIDED UP-GRADATION OF VARIOUS POSTS IN GRADE BS-5 TO GRADE BS-14 FROM FIRST JULY 2010.
    THE POST HELD BY SUB-ENGINEER’S & OTHERS WERE ALSO UPGRADED IN BS-16.
    IT IS ALSO HIGHLIGHT THAT THE UP-GRADATION OF THE POST NOT A PROMOTION BUT IS ONLY A PERSONAL BENEFIT OF THE PRESENT HOLDERS OF SAID POST FOR INCREASING THEIR SALARY.THE ACTUAL GRADE OF SAID POST AT THE TIME INITIAL APPOINTMENT EVEN NOW REMAIN THE SAME IN CDA SERVICE REGULATION, 1992. AFTER THE COMPLETION OF (05) FIVE YEARS SERVICE IN THE INITIAL GRADE, POST HELD BY AN EMPLOYEE IN GRADE -5 TO 14 IS UPGRADED TO INCREASE THE SALARY. IT IS NOT PROMOTION TO HIGHER GRADE.SUCH EMPLOYEES REMAINED ENTITLED TO THE ALLOTMENT OF PLOTS IN THEIR ACTUAL GRADE OF PAY SCALE BEFORE 1st JULY 2010.

    THAT THE SOME EMPLOYEES OF CDA SUBMITTED VARIOUS APPLICATIONS TO THE RESPECTIVE MEMBER OF THE CDA AUTHORITY CONCERNED FOR RE-DETERMINATION THE SENIORITY LIST FOR THE PURPOSE OF ALLOTMENT OF RESIDENTIAL PLOTS .THE MEMBER (PLANING & DESIGN), CDA WHO ALSO HOLDS THE POST OF MEMBER (ESTATE), WHILE ENTERTAINING THE APPLICATION OF THE CDA EMPLOYEES DID SEE LOGIC IN THE RES QUEST MADE BY THE EMPLOYEES AND ENTRUSTED THE MATTER TO THE DIRECTORATE OF ESTATE MANAGEMENT FOR PROCESSING THE CASE OF THE APPLICANTS. HRD DIRECTORATE PROCESSED THE CASE FOR LEGAL OPINION THROUGH MEMBER (ADMIN) & MEMBER (ESTATE). IN HIS OPINION THE LEGAL ADVISOR, CDA OPINED THAT THE UPGRADATION WAS ONLY EXTENSION OF PAY AND ALLOWANCES AND NOT PROMOTION AS DEFINED PROCEDURE IN CDA EMPLOYEES SERVICE REGULATIONS 1992. AND THE SENIORITY OF THE OFFICIALS IN A PARTICULAR CATEGORY OF PLOT TO BE FIXD IN THE LIGHT OF THE SUBSTANTIVE APPOINTMENT AND PROMOTION ACCORDING TO THE RULES,

    THE UPGRADATION OF POST IS NOT PRMOTION IN ACCORDANCE WITH CDA SERVICE REGULATION 1992. IT IS AN INCREASED PAY ONLY FOR THE EMPLOYEES HOLDJNG POST IN SPECIFIC GRADE. IT IS ALSO EVIDENT FROM THE FACT THAT EVEN TODAY INITIAL APPOINTMENT IS MADE IN THE SCALE WHICH IS SPECIFIED IN THE CDA EMPLOYEES SERVICE REGULATION 1992 AND ONLY AFTER 05 YEARS CONTINUOUS SERVICEIN THE BASIC PAY SCALE , THE POST HELD BY SUCH EMPLOYEE IS UPGRADED. HENCE, THE UPGRADATION OF POST IS NOT A PROMOTION BUT IS A MONETRY BENEFIT WHICH IS ALLWED TO PERSON OF THE SPECIFIC POST. IT IS ALSO FURTHER EVIDENT THAT NO PROCESS OF PROMOTION AS ENVISAGED IN THE CDA EMPL OYEES REGULATION 1992 HAS BEEN FPLLOWED WHILE GIVING PERSONAL BENEFIT OF HIGHER GRADE TO THE SPECIFIC EMPLYEES.
    THE UPGRADED EMLOYEES HAVE TO BE INCLUDED IN THE GRADE WHICH THEY WERE SUBSTANTIALLY HOLDING IMMEDIATELY BEFORE THE UPGRADATIN.
    IN ACCORDANCE WITH LAW SENIORITY LIST HAVE TO BE PREPARED ON THE BASIS OF SBSTANTIVE PAY SCALE HELD BY THE EMPLOYEE IMMEDIATELY BEFORE THE RECENT UPGRADATION. COPIES OF THE APPLICATIONS AND THE NOTIFICATION REGARDING UPGRADATION OF BASIC PAY SCALE ARE ALSO APPENDED.

    THAT THE HUMAN RESOURCES DIRECTORATE HAS REQUESTED ALL THE CONCERNED DIRECTORATE TO PREPARE THE LIST OF EMPLOYEES IN GRADE BPS-1 TO 16 WHO HAVE 08 YEARS REGULAR SERVICE AT THIR CREDIT FOR THAT PURPOSE HRD HAS MADE 04 CLASSIFICATIONS OF BPS (BASIC PAY SCALE ) CATEGORIES OF PLOTS.

    THAT THE OBJECT OF CATEGORIZTION OF VARIOUS GRADE IN BS FOR ALLOTMENT OF RESIDENTIAL PLOTS TO SPECIFY THE CATGORY OF PLOT TO BE ALLOTTED TO THE EMPLOYEE AND IS NOT MEANT FOR MAKING COMBINE SENIORITY LIST OF BPS-1 TO 6, 7 TO 10, 11 TO 13, AND 14 TO 16, FOR ALLOTTING RESIDTIAL PLOTS. FOR THE PURPOSE OF ALLOTMENT SENIORITY IN EACH GRADE IS TO BE REKONED SEPARATLY.

    THAT THE ENTITLEMENT OF THE APPLICANTS FOR THE ALLOTMENT OF PLOTS OF THE SPECIFIC CATEGORY IS TO BE SEEN WITH REFERENCE TO THIER SENIORITY AND LANTH OF SERVICE IN PARTICULAR BASIC PAY SCALE TO WHICH THEY WERE APPOINTED OR PROMOTED, THEREFORE SEPARATE SENIORITY LIST HAS TO BE PREPARED IN RESPECT OF EACH PAY SCALE AND THE SENIORITY OF DIFFERENT SCALES CANNOT BE LUMPED TOGATHER DETERMINE THE ENTITLEMENT TO THE ALLOTMENT OF RESIDENTIAL PLOTS.

    THAT THE UPGADATION OF VARIOUS POSTS HAVE BEEN MADE ONLY IN THE CDA ON THE DEMAND OF CDA MAZDOR UNION ONLY FOR THE PURPOSE OF SALARY BENEFIT.THE SENIORITY OF THE EMPLOYEES IS TO BE DETERMINED WITH REFERNCE TO THE POST TO WICH HE IS APPOINTED OR PROMOTEDIN ACCORDANCE SERVICE RULES.

    THAT FOR THE PURPOSE OF ALLOTMENT OF RESIDENTIAL PLOTS, ACCORDING TO THE CDA BOARD DECISION, IT IS THE LENGTH OF SERVICE AND NOT THE LENGTH OF SERVICE IN THE PRESENT GRADE OF SERVICE WHICH WILL DETERMINE THE
    ENTITLEMENT.

    THAT THE SUB-ENGINEER ETC , WHO HAD MUCH LONGER SERVICE IN THEIR BASIC RESPECTIVE PAY SCALE HAVE BEEN RENDERED JUNIOR TO THE NEW ENTRANT BECAUSE OF THE UP-GRADATION OF POST.
    THIS HAS RESULTED ONCE AGAIN THROWING THE SUB-ENGINEER & ETC AT SUCH END OF THE SENIORITY LIST WHERE THEY WOULD NOT HAVE ANY CHANCE OF ALLOTMENT OF RESIDENTIAL PLOTS.

    THAT AS A RESULT OF UP GRADATION OF POST ASSISTANT SUB-ENGINEER’S ETC., THERE HAS BEEN AN INFLUX OF EMPLOYEES IN BS-14 AND BS-16 FIRST JULY 2010, AND THE SUB-ENGINEER’S WERE HOLDING POSTS IN BS-14, THROUGH DIRECT APPOINTMENT OR PROMOTION IN ACCORDING WITH THE SERVICE REGULATION PRIOR TO FIRST JULY 2010. THE LIST OF EMPLOYEES ENTITLED TO CATEGORY-III PLOTS STAND INFLATED AND MANY PEOPLE HAVING MORE LENGTH OF SERVICE ARE GRADE 14TO 16 THERE IS NO ELEMENT OF PROMOTION AS ENVISAGED IN CDA SERVICE REGULATION, 1992.

    THAT THE PRESENT SENIORITY LIST FOR THE ALLOTMENT OF PLOT HAS BEEN MADE ON THE BASIS OF THE HOLDERS OF UPGRADED POSTS AND AS RESULT THERE OFVERY ANOMALOUS SITUATION HAS BEEN CREATED.MAJORITY OF THE EMPLOYEES WHO WERE SUBSTANTIVELY HOLDING, UDCs (UPPER DIVISION CLERK) POST IN GRADE BS-9 WERE UPGRADED IN BS-14 WITH RE-DESIGNATION OF UDC AS SUB-ASSISTANT LIKEWISE VARIOUS POSTS IN GRADE 13&14 HAVE BEEN UPGRADED AS BPS-16 AND VARIOUS POSTS IN BPS- 11 TO 12 HAVE BEEN UPGRADED IN BS-13 & 14.

    THAT THE DIRECTORATE OF STATE MANAGEMENT-II CDA WHO IS TO MAKE ALLOTMENT HAS SUBMITTED FOLLOWING PROPOSALS:

    i. PLOT MAY BE ALLOTTED ON BPS BASIS, INSTEAD OF UPGRADED SCALES BECAUSE UPGRADATION IS GIVEN ONLY TO FEW GRADE OF BPS. RESTS OF EMPLOYEES ARE STILL IN BPS. IN THIS WAY, THE ISSUE OF APPLICANTS WILL BE RESOLVED AUTOMATICALLY. ALTHOUGH ALL THE PROPOSALS SUPPORT THE APPLICANTS:

    THAT THE IRONY OF THE CIRCUMSTANCE IS THAT DESPITE FULLY CONSCIOUS OF THE JUSTIFICATION OF THE REQUEST OF THE APPLICANTS:

    THE DICISION HAS NOT YET BEEN TAKEN BY THE CDA AUTHORITY CONCERNED, WHILE THE DATE OF BALLOTING IS GETTING CLOSURE.

    HONORD SIR: YOUR KIND OF HONOR & YOUR GOOD SELF IS VERY HUMBLY AGAIN REQUESTED THAT TO PREPARE THE LIST OF EMPLOYEES IN GRADE BPS-1 TO 16 WHO HAVE 08 YEARS REGULAR SERVICE AT THIR CREDIT THE SENIORITY OF THE OFFICIALS IN A PARTICULAR CATEGORY OF PLOT IS TO BE FIXED IN THE LIGHT OF THE SUBSTANTIVE APPOINTMENT AND PROMOTION ACCORDING TO THE CDA SERVICE REGULATION, RULES 1992, AFTER THE UPGRADED EMPLOYEES HAVE TO INCLUDE IN THE GRADE WHICH THEY WERE SUBSTANTIALLY HOLDING IMMEDIATELY BEFORE THE UPGRADATION. SO THAT THE RIGHT OF ACTUAL ENTITLED OF PLOTS, AND ACTUAL SENIOR OFFICIALS IS NOT DAMAGED. OR THE PRESENT PROMOTES MAY, BE PLACED IN SENIORITY OF PLOTS AFTER THE OFFICIALS WHO WERE BASICALLY SENIOR TO THEM IN THE CAT-III IN WHICH THEY HAVE NOW BEEN INCLUDED. AND NO HOUSE IN ANY MAJOR CITY OF PAKISTAN SHALL BE GIVEN FIRST PRIORITY AND THOSE HAVING NO HOUSE IN ISLAMABAD ALONE SHALL HAVE SECOND PRIORITY.
