The Sindh High Court (SHC) issued notices to Secretary and Section Officer of the Ministry of Interior on a contempt application filed by a businessman for violation of court order.
Majid Bashir submitted that despite court order on July 16 for removing his name from the Exit Control List (ECL), the alleged contemnor did not comply. The petitioner’s counsel Abdul Sattar Pirzada submitted that the order of the court has been forwarded to the alleged contemnor for compliance but they opted to disobey directions.
The SHC’s division bench comprising Justice Mushir Alam and Justice Mohammad Athar Saeed after preliminary hearing of the application issued notice to the alleged contemnors and called their comments through the deputy attorney general after two weeks.
PETITION FOR REGISTRATION OF FIR AGAINST MUSHARRAF: The SHC adjourned sine die the petition seeking the registration of a FIR against former President Pervez Musharraf. Petitioner Agha Syed Atta Shah submitted that he approached the federal investigation agency (FIA) for registration of a FIR against Musharraf to register a case against him under section 2 of High Treason Act read with Article 6 of the Constitution as his acts regarding imposition of emergency and Provisional Constitution Order (PCO) are criminally disloyal to the country by subverting the Constitution.
He said that the respondent misused his power through unconstitutional means and removed 60 judges of the superior courts.
As the matter was taken up before the SHC’s division bench comprising Chief Justice Sarmad Jalal Osmany and Justice Sajjad Ali Shah, the court observed an identical matter is also pending before the Supreme Court (SC) and adjourned the matter sine die till the decision of the SC arises.
