ISLAMABAD: The Supreme Court was informed on Friday that 80 kanals of land grabbed by the brothers of the Pakistan People’s Party (PPP) Leader of the House in Senate Syed Nayyar Hussain Bukhari at Bani Gala has been evacuated.
A three-member bench, comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Ghulam Rabbani and Justice Khalilur Rehman Ramday, was hearing a suo moto case initiated on a letter of the Pakistan Tehrik-e-Insaf (PTI) chief Imran Khan to the Chief Justice of Pakistan (CJP) against illegal occupation and grabbing of land at Bani Gala by Nayyar Bukhari and his relatives.
Appearing on notice, Capital Development Authority (CDA) Chairman Imtiaz Inayat Elahi told the court that over 300 kanals of land at Bani Gala has been evacuated from his possession. He said that out of 300 kanals, 80 kanals of land was occupied by the brothers of Nayyar Bukhari.
During the course of hearing, Justice Khalilur Rehman Ramday observed that CDA Chairman Imtiaz Inayat Elahi was among the legal community as his father was a very honourable judge of the Peshawar High Court (PHC).
“He is among us but even we don’t spare him and don’t show any favour to him as well,” the chief justice remarked.
To a court query, the CDA chairman said that 20,000 acres land of CDA at various villages was still in the possession of the original owners, despite the fact that payment for the land as well as built up property has been made in 1960 and 1970.
The court then directed the CDA chairman to take immediate steps for vacation of state land for which all the benefits have been paid and dispose of the matter. On the last hearing, Nayyar Bukhari, who appeared on court notice, had contended before the court that he or his family had not occupied any state land.
He, however, had contended that some people were defaming him on political basis, adding that he had not grabbed any land at Bani Gala and his family owned some land in the area legally. “The 80 kanals of land that Imran Khan had mentioned is not in my control and if it is, CDA can take it anytime,” Bukhari had said.
He had claimed that Imran Khan was trying for political scoring, adding that Imran’s own house at Bani Gala was in prohibited area. Justice Ramday then had said: “If it is so, then you are in government, and why don’t you take action against him.”
The court had informed Bukhari that the CDA chairman himself had admitted during the chamber hearing that the state land was occupied by Bukhari and his relatives. Bukhari then had told the court that Imran Khan was occupying the state land of over 700 kanals.
In his letter to the CJP, Imran Khan had said that with the connivance of the CDA officials, Nayyar Bukhari and his relatives had occupied the civic body’s land.
