AN ADDITIONAL district and sessions judge on Tuesday issued notice to police on a petition seeking directions for registration of a criminal case against Gen (retd) Pervez Musharraf.
The petition was moved by Syed Azhar Ali Shah advocate who alleged that that the former President Gen (Retd) Pervez Musharraf had issued an illegal order on Nov 3, 2007, against the judges of the whole country and the law enforcing agencies trespassed on their houses and the court premises and forcibly arrested and baton charged the lawyers.
He said Musharraf had illegally detained the judges, including Chief Justice of Pakistan Iftikhar Muhammad Chaudhry along with Justice Khawaja Sharif, Justice Shahid Siddiqui, Justice Khalilur Rehman Ramday and other judges of the High Courts as well as the Supreme Court. He said a number of lawyers got fatal injuries and many of them were set ablaze with petrol. Some of them succumbed to their burns and the respondent was liable to be proceeded under sections 302,324,334,336,337,342 of the PPC.
The petitioner said when he approached the SHO Islampura for the registration of the case he flatly refused to register the case. He prayed before the court that SHO Islampura might be directed to register a criminal case against Pervez Musharraf. The court, after accepting the petition, issued notice to the SHO Islampura for September 2.
