Karachi—The Karachi bench of Sindh High Court (SHC) has issued a stay order in favour of M/s Emaar Giga International EZCO against the defendant, Pakistan Defence Officers’ Housing Authority (DHA) prohibiting the defendant from raising any construction on the disputed land of the Crescent Bay Project and from interfering with any development work carried out by the plaintiff (Emaar Giga International).
On the plea of Emaar Giga International the court has also put restrictions against the defendant DHA not to change the status of the property currently in possession of the complainant, or interfere in the construction on the disputed land, or the work which has been already carried out by the plaintiff (Emaar Giga International) or from making any change or variation in it and from creating any third party rights or interest or in any manner changing the status of the property and land or the constructions till the final disposal of the matter.
It may be mentioned here that M/s Emaar Giga International through their counsel had filed a complaint against DHA praying to issue a stay order against the defendant after DHA officials took over the Crescent Bay Karachi project site in DHA phase 8 last month.
